1. About BargainPHV

BargainPHV is a communications and trip-matching platform for users, Private Hire Operators, private hire drivers and taxi drivers. BargainPHV helps users create trip requests and connect directly with the trade for airport, port and postcode journeys.

BargainPHV does not accept, process, manage or confirm transport arrangements. BargainPHV does not dispatch vehicles and is not a Private Hire Operator, taxi operator, transport provider, agent or broker.

2. Definitions

User means a person using BargainPHV to create, match, view or discuss a trip request.

Trade Member means a PHO, private hire driver or taxi driver registered with BargainPHV.

Trip Request means information submitted through BargainPHV for a proposed journey.

Trip Match means a possible match between journeys, users or trade members. A trip match is not a confirmed transport arrangement.

StopSwap means matching journeys by location, date and time so that a PHO or taxi driver may reduce empty mileage and improve journey efficiency.

3. Eligibility

You must be at least 18 years old to register, create a request, message another party or use BargainPHV. By using the platform, you confirm that you are 18 or older.

4. BargainPHV’s Role

BargainPHV acts only as a facilitator. Any transport arrangement, including the final fare, pick-up point, drop-off point, waiting time, vehicle suitability, route, passenger assistance, luggage capacity and additional charges, must be agreed directly between the user and the relevant PHO or taxi driver.

BargainPHV is not responsible for the actions, omissions, licensing, insurance, pricing, availability, suitability, conduct or performance of any PHO, private hire driver or taxi driver.

5. Trip Requests and Trip Matching

Users may create trip requests for supported services including London Airports, Airports & Ports, and other available trip-matching areas shown on the website.

A trip request does not guarantee that a match, response or suitable PHO or taxi driver will be available. BargainPHV may limit users to one live request at a time where required by the system.

Requests may be removed, expired, cancelled or marked inactive where they are no longer valid, unanswered, completed, duplicated, abusive, incorrect or outside the permitted service rules.

6. Messaging and Acceptance

BargainPHV messaging is provided to help users and trade members discuss trip details. Users should not share sensitive personal information until they are satisfied that they are communicating with the correct PHO or taxi driver.

Where the platform shows an accept, reject, consider or message option, that action is for platform workflow only. The actual transport arrangement must still be agreed directly with the PHO or taxi driver.

7. Fare Ranges and Additional Charges

Fare ranges shown on BargainPHV are estimated or negotiated ranges only. They are not fixed offers from BargainPHV and are not transport charges set by BargainPHV.

The final fare must be agreed directly between the user and the PHO or taxi driver. Extra charges may apply, including but not limited to airport pick-up or drop-off charges, car parking, waiting time, additional stops, tolls, congestion charges, ULEZ, VAT or other local charges.

8. Trade Member Responsibility

Trade members are responsible for holding and maintaining all licences, insurance, permissions and legal authority required to provide their services.

Trade members must comply with all relevant licensing authority rules, including TfL rules where applicable, and all local authority taxi or private hire rules relevant to their work.

9. User Responsibility

Users are responsible for checking journey details, confirming the identity of the PHO or taxi driver, agreeing the final fare and ensuring the proposed journey is suitable for their needs before travelling.

Users should confirm the driver, vehicle details, destination, PHO or taxi business name, agreed fare and any extra charges before starting a journey.

10. Conduct Rules

Users and trade members must not use BargainPHV for abusive, threatening, racist, discriminatory, harassing, misleading, unlawful or fraudulent conduct.

BargainPHV may suspend, restrict or remove access where it believes a user or trade member has misused the platform, breached these terms or created risk to others.

11. No Payment Demands from BargainPHV to Users

BargainPHV will not demand payment from users for transport services by email, letter, social media or platform message. Any journey payment must be agreed directly with the PHO or taxi driver.

12. Data Retention

BargainPHV may remove expired, inactive, completed or unanswered requests and related messages after the relevant request date or expiry period. Operational records may be retained where necessary for security, dispute handling, legal compliance or platform administration.

Personal data is handled in accordance with the BargainPHV Privacy Policy.

13. Intellectual Property

BargainPHV, StopSwap, CommuterShare, related branding, platform content, service names, designs, text, layouts, graphics and software are protected by intellectual property rights.

You may not copy, reproduce, reverse-engineer, scrape, republish, exploit or misuse BargainPHV content or systems without written permission.

14. Limitation of Liability

BargainPHV provides the platform on an “as is” and “as available” basis. BargainPHV does not guarantee uninterrupted access, successful matching, response times, availability of PHOs or taxi drivers, or the outcome of any trip request.

To the fullest extent permitted by law, BargainPHV accepts no liability for loss, delay, cancellation, fare disputes, missed travel, missed flights, missed connections, damage, injury, conduct issues, regulatory breaches, or failure to perform arising from arrangements made directly between users and PHOs or taxi drivers.

15. Overseas Users

BargainPHV is operated from the United Kingdom. If you access the platform from outside the United Kingdom, you are responsible for complying with any local laws that apply to you.

16. Changes to These Terms

BargainPHV may update these Terms & Conditions from time to time. Continued use of the platform after changes are published means you accept the updated terms.

17. Governing Law

These Terms & Conditions are governed by the laws of England and Wales. Any dispute will be subject to the courts of England and Wales.
